1. Acceptance of Terms

Websites Baratos is an online project managed by Cláudio Pereira, available at claudiopereira.pt. By engaging Websites Baratos, the client fully accepts these Terms and Conditions. Contracting our services implies knowledge and acceptance of all clauses described herein. If you disagree with any condition, you should not use our services.

2. Services Provided

Websites Baratos provides website creation, development and maintenance services, online shops, landing pages, SEO and digital marketing. Services are provided on an annual subscription basis, including hosting, domain, SSL, technical support and continuous improvements throughout the contract. The website will progressively become more complete and tailored to the client's needs as the business relationship evolves.

3. Payment Terms

Payment is divided into two instalments: 50% at the start of the project, before work begins, and the remaining 50% upon delivery. For projects exceeding €1,500, special conditions may be agreed. All prices are subject to VAT at the applicable legal rate.

4. Refund and Cancellation Policy

In the event of cancellation by the client after work has begun, the first instalment (50%) is non-refundable. This amount is lower than the costs actually incurred by Websites Baratos at project start, including working time, licences, hosting and domain setup. The client acknowledges that this amount constitutes partial, not full, compensation for costs incurred.

5. Delivery Timeframes

The standard delivery time is approximately 1 month for websites and 2 months for online shops. These timeframes are estimates and Websites Baratos typically aims to deliver ahead of schedule. Delivery depends directly on the client and external factors, including the speed at which the necessary content is provided (text, images, logos, products, contact information and other elements), the availability of third-party services and any technical constraints outside our control. Delays caused by the client's failure to provide content in a timely manner are not the responsibility of Websites Baratos and do not constitute grounds for cancellation or refund.

6. Changes and Maintenance

Minor changes to the website, such as updating text, phone numbers, opening hours, prices, images or adding new images, are free and included in the service. Unlike many companies in the sector, Websites Baratos does not charge for this type of modification. However, we reserve the right to request additional compensation in the event of an excessive volume of requests in a short period of time, in order to maintain service quality for all clients. Requests for new features or full redesigns will be quoted separately and paid as a one-off cost, with no increase to the annual subscription unless specifically justified and agreed with the client.

7. Intellectual Property

Services are provided on an annual subscription basis. During the contract period, the client holds a right of use of the developed website. Intellectual property, including source code, design and structure, remains with Websites Baratos until termination and full settlement. To acquire definitive ownership of the website and all its files, the client must pay an amount equal to 3 (three) times the construction cost of the website and its components, calculated based on the work actually carried out. The construction cost includes all developed elements: pages, features, additional languages, integrations and any other components, each valued individually. Websites Baratos may include the project in its portfolio.

8. Third-Party Liability and Security

Websites Baratos is not responsible for failures, interruptions or damages caused by third-party services, including hosting providers, domain registrars, payment platforms or other external services. We are also not responsible for hacking attacks, unauthorised access to the website or its data, monetary losses, fines or legal penalties resulting from the client's activities. It is the client's responsibility to ensure that the content of their website complies with the legislation applicable to their business. We recommend that clients regularly consult qualified professionals, such as accountants, lawyers or consultants in their field, to ensure all published information is accurate and legally compliant. The client must inform Websites Baratos of any legal, tax or regulatory changes that affect the content of their website.

9. Warranty and Continuous Improvement

After delivery, a 30-day technical warranty is provided for the correction of bugs and errors resulting from development. This warranty does not cover content changes, new features, errors caused by client intervention or issues originating from third-party services. Beyond this initial warranty, the annual subscription itself ensures the website continues to function correctly and is continuously improved, particularly in terms of SEO, with the goal of achieving top positions on search engines such as Google. This optimisation work is ongoing and carried out with the utmost dedication, although it is not possible to guarantee specific positions in search results, as these depend on external factors outside our control.

10. Contract Termination

Either party may terminate the contract with prior written notice. In the event of termination by the client during the annual period, no proportional refund of amounts paid will be made, as maintenance, support and improvement services are provided continuously throughout the year. In the event of termination by Websites Baratos, a proportional refund for the unused period will be issued, except in cases of breach of these conditions by the client.

11. Governing Law and Dispute Resolution

These terms are governed by Portuguese law. In the event of any doubt, complaint or dispute, we encourage the client to contact our support team first at info@websitesbaratos.net, so that the matter can be resolved amicably and promptly. If an agreement cannot be reached, the dispute may be submitted to the competent Portuguese courts.
